EXTENSIONS AND NEW CONNECTIONS

§ 52.10 NEW CONNECTIONS TO SANITARY SEWERS.

The connection of the building sewer into the public sanitary sewer shall conform to the requirements of the Town plumbing code and other applicable rules and regulations of the Town and TPWA.

(A) All new sanitary sewer systems shall be designed and constructed in accordance with the requirements of the Oklahoma Department of Environmental Quality other than ODEQ regulating aerobic systems which are not permitted in the Town, and applicable building and plumbing codes of the Town and the rules and regulations of the TPWA.

(B) No private sewer connection, whether inside or outside the Town limits, shall be made to any sanitary sewer line directly or indirectly connected with the TPWA’s public sanitary sewer main system without receiving approval of the TPWA Sewer System Operator.

(C) All new connections shall be inspected by the TPWA Sewer System Operator or the Town Building Inspector and charged a connection fee payable to TPWA as established by resolution or motion of the TPWA.

(Ord. 2024-01, passed 5-14-2024)

§ 52.11 SANITARY SEWER LINE EXTENSIONS.

(A) When a public sanitary sewer is available within the Town limits the building sewer shall be connected to the sanitary sewer within sixty (60) days at the expense of the property owner. The Sewer System Operator may reasonably extend the time a building has to connect to the sanitary sewer line extension for construction-related delays.

(B) All users connecting to a sanitary sewer line extension which is funded in part by the TPWA, either by cash expenditure or the furnishing of labor in constructing the extension, shall pay a fee as set by the TPWA for connecting to the sanitary sewer line extension.

(C) Any user desiring a connection to a sanitary sewer line extension in which the fee in Subsection B is due shall either pay the fee before being allowed a connection or shall execute a promissory note in the amount due with interest thereon at the date to be set by the Sewer System Operator, providing for twelve (12) monthly amortized payments, payable to the TPWA, before being allowed to connect to the sanitary sewer line extension. The monthly payments required by the promissory note given by a user shall be billed on the monthly sewer bill sent to the user. Nonpayment of the note payments shall be grounds for terminating utility service to the user.

(D) The fee in Subsection B hereof shall be automatically adjusted annually for inflation.

(Ord. 2024-01, passed 5-14-2024)

§ 52.12 CONNECTION TO A PUBLIC SANITARY SEWER UPON ANNEXATION.

The property line of any structure annexed into the Town must connect to the public sanitary sewer line within ninety (90) days at the expense of the property owner. The Sewer System Operator may reasonably extend the time a building has to connect to the sanitary sewer line extension for construction-related delays. The Board of Trustees of TPWA may grant an exemption from connection to the public sanitary sewer system for existing structures located in an area annexed by the Town as set forth in Section 52.09 hereof.

(Ord. 2024-01, passed 5-14-2024)

§ 52.13 CRITERIA FOR SANITARY SEWER LINE EXTENSION CONNECTION EXEMPTIONS.

(A) The Board of Trustees of TPWA may grant an exemption for existing structures to connect to the extension of a sanitary sewer line if the following requirements are met:

(1) The existing private sanitary sewer system is determined to be in good working order;

(2) The existing private sanitary sewer system meets the minimum requirements of the Oklahoma Department of Environmental Quality other than the ODEQ requirements for an aerobic system which are not permitted in the Town; and

(3) Connection to the sanitary sewer line extension would be cost prohibitive.

(B) TPWA may negotiate an exemption for existing structures to connect to the sanitary sewer line extension in exchange for an easement or annexation into the Town if:

(1) The existing private sanitary sewer system is in good working order; and

(2) The existing private sanitary sewer system meets the minimum requirements of the Oklahoma Department of Environmental Quality other than ODEQ requirements for aerobic systems which are not permitted in the Town.

(C) Any existing structure granted an exemption shall be deemed a lawful nonconforming use as governed in the Town Zoning Code. Repairs and routine maintenance may by performed on the private sewer system as long as the following criteria is met:

(1) The cost of such repair or maintenance work does not exceed 50% of the replacement cost of such system or 50% of the estimated cost to connect to the public sanitary sewer lien extension; and

(2) The existing private sanitary sewer system meets the current minimum requirements of the Oklahoma Department of Environmental Quality other than ODEQ requirements for aerobic systems which are not permitted in the Town.

(D) The TPWA Board of Trustees may extend deadlines to connect to sanitary sewer system by motion or resolution.

(E) All other ordinances regulating nonconforming uses shall apply except when in conflict with this Chapter.

(Ord. 2024-01, passed 5-14-2024)
